Terms of Service

1. Acceptance of these terms
By using Findably (“the Service”) you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is operated by a Kansas limited liability company (“Findably,” “we,” “us”).
2. What the Service does
Findably runs an automated audit of how a business appears to AI agents (such as ChatGPT, Gemini, and Perplexity) and to related public sources. We pull data from public APIs, query third-party AI models with category-and-city prompts, and score the result on a 0–100 scale across multiple dimensions.
3. Audit results are informational
Our scores and recommendations are informational only. They are based on third-party data that may be incomplete, out of date, or inaccurate, and on AI model responses that vary across runs. Findably does not guarantee any specific outcome (including search ranking, AI mention rate, or business growth). You are responsible for evaluating any recommendation before acting on it.
We are not affiliated with Google, OpenAI, Anthropic, or any other third-party platform we query.
4. Acceptable use
You agree not to:
- Use the Service to audit a business without a legitimate business reason (for example, mass-auditing competitors to harass them).
- Scrape, mirror, or programmatically harvest the Service or its outputs.
- Reverse engineer, decompile, or attempt to extract our scoring algorithm.
- Misrepresent yourself, impersonate a business owner, or submit fraudulent payment information.
- Interfere with the Service’s operation, attempt to defeat rate limits, or probe for vulnerabilities outside a coordinated disclosure process.
- Use the Service in violation of applicable law (including CAN-SPAM if you redistribute report content by email).
5. Subscriptions and billing
Paid subscriptions are billed monthly through Stripe. By subscribing you authorize Findably (via Stripe) to charge your payment method the published rate until you cancel.
- Cancellation. You can cancel any time. Your subscription remains active through the end of the current billing period.
- Refunds. Charges are non-refundable except where required by law, but we will work in good faith to resolve billing errors.
- Price changes. We may change pricing for new billing periods with at least 30 days’ notice by email.
- Taxes. Prices do not include taxes. You are responsible for any applicable sales, VAT, or similar taxes.
6. Intellectual property
Findably owns the Service, the audit methodology, the report templates, and all associated software. We grant you a limited, non-transferable license to use the Service and to use the reports we generate for your own business purposes, including sharing them with your team. You retain rights to any business information you provide.
7. Disclaimer of warranties
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Findably disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate.
8. Limitation of liability
To the maximum extent permitted by law, Findably’s aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid Findably in the 12 months before the claim arose, or (b) US $100. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or business interruption.
9. Indemnification
You agree to indemnify and hold Findably harmless from any third-party claim arising from (a) your misuse of the Service, (b) your violation of these Terms, or (c) your violation of any law or third-party right in connection with your use of the Service.
10. Termination
We may suspend or terminate your access if you violate these Terms or if we are legally required to do so. You can stop using the Service at any time; if you have a subscription, you should cancel it via your account or by emailing us.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced on the site or by email. Continued use of the Service after a change constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Kansas, United States, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Johnson County, Kansas, and you consent to that jurisdiction.
